Transport of passengers
In a case involving the contractual liability of the sea carrier for an accident occurred to a passenger during a cruise, by the judgment no. 3199 dated 3.11.2014 the Tribunal of Taranto found that the carrier proved to have adopted all appropriate safety measures to prevent accidents to passengers and, in particular, to significantly reduce the risk of falls of passengers on the outer decks. The Tribunal held that the fall was caused by carelessness of the passenger which amounts to unforeseeable circumstances such as to exclude any direct and immediate causative link between performance of the carriage and the damage suffered by the passenger. Therefore, the Tribunal dismissed the passenger’s claim. The sea carrier was represented by Studio Legale Mordiglia.
