The new limits of shipowners’ liability

On 19th April 2005, in accordance with the revision procedure of the 1976 London LLMC (Convention on Limitation Liability for Maritime Claim) introduced by art. 8 of the 1996 Protocol, new limits of Shipowners’ liability, provided for by IMO Resolution 19th April 2012, came into force. As a result, the limits of the Shipowners’ liability foreseen by Art. 6 of 1976 LLMC Convention, as amended by 1996 Protocol, increased by 51% as follows: a) claims for death or personal injuries – 3.02 mln SPR for vessels up to 2.000 ton – 1.208 SPR for each ton from 2.001 to 30.000 – 906 SPR for each ton from 30.001 to 70.000 – 604 SPR for each ton in excess of 70.000 b) other claims – 1.51 mln SPR for vessels up to 2.000 ton. – 604 SPR for each ton from 2.001 to 30.000 – 453 SPR for each ton from 30.001 to 70.000 – 302 SPR for each ton in excess of 70.000 It is worth to remember that Italy has not ratified the 1976 LLMC Convention and its Protocol. However Italy adopted corresponding rules of national law by the Law Decree n. 111/2012. As a result, the above mentioned amendments don not automatically operate into Italian Law and the limits of Shipowners’ liability are those as provided for by the said Italian Law Decree.
