Judgement on haulage minimal costs by Tribunal of Genoa 30.11.2015

By a judgment issued on 30th November 2015, the Tribunal of Genoa, following the decision of the EU Court of Justice dated 4 September 2014, held that the Italian rules on the haulage minimal costs are in conflict with the EU laws as they restrict competition and are not supported by public reasons worthy of protection. As a result, the Tribunal set aside the summary judgement previously issued in favor of the hauler for the cost difference. The judgment stated that the minimal costs are illegal regardless of their determination by the Observatory or the Ministry.
