Legislative Decree 29/2026: new fines up to €150,000 for batteries without the disposal symbol

Legislative Decree 29/2026, implementing Regulation 2023-1542 on batteries, has finally been published in the Official Gazette of the Italian Republic (GGUU) and has been in force since March 7.

The old Legislative Decree 188/2008, which contained the well-known fine of €50 to €1,000 for each battery without the disposal symbol, has been repealed.

The new Legislative Decree, in Article 34, establishes a fine of €10,000 to €150,000, regardless of the number of batteries.

Therefore, from now on, an importer will be charged double the minimum fine (€20,000) and no longer the fine commensurate with the number of batteries without the crossed-out wheeled bin symbol.
