The Latest Developments in BIMCO: SUPERMAN 2025 and ASBATANKVOY 2025
The new SUPERMAN form regarding supervision in vessel construction updates the previous 2016 version. The recent changes aim to align it with SHIPMAN 2024 and CREWMAN A and B 2025, as these share the same liability regime. Like SHIPMAN, it features a “cost plus fee” scheme, under which the supervisor acts on behalf of its clients.
Among the most significant innovations are the introduction of a definition of “regulatory authorities”, a clearer specification of supervisors’ powers, their ability to make use of assistants and delegates, and the possibility of benefiting from potential tax deductions.
A 12‑month period is set within which the appointing Company may hold the supervisor liable for loss of the vessel, damage to the vessel, delivery delays, or additional expenses beyond what was originally agreed. This period runs from the date of delivery of the vessel, or from early termination (should such condition occur under clause 18).
ASBATANKVOY concerns tanker charter parties and has also undergone major changes after almost fifty years since its first drafting. It is now divided into three sections: a preamble, containing the definition of “Owner” (specifying whether it is a registered Owner, disponent Owner, or time‑chartered Owner), Part I, containing the detailed agreements between the parties, and Part II, with standard provisions that apply automatically unless expressly waived by the parties.
The model does not address environmental aspects, deemed too unstable and subject to continuous changes. Conditions regarding Carbon Intensity Indicator (CII), Emission Trading Schemes (ETS), or FuelEU Maritime are therefore absent. The same applies to sanctions clauses, for the same reasons. The only exception is sub‑clause 9(c), which allows the Owner to refuse proposed lightering/STS operations if the STS vessel or its owner is subject to sanctions.
Finally, unlike the previous version, the current ASBATANKVOY is accompanied by a standalone bill of lading proforma rather than being a simple appendix to the form itself.
