On-line contracts and the Montreal Convention 1999

By judgment no. 18527/2019 the United Sections of the Italian Court of Cassation ruled that, in case of contracts concluded on-line, Art. 33.1 of the Montreal Convention 1999 in matter of air transport, in the part in which enables the injured person to sue the air carrier in the courts where the latter has a place of business through which the contract has been made, must be interpreted as meaning that such place corresponds to the place of residence of the passenger, being the place where the passenger receives confirmation of his reservation.
